No smoking zones
In 2020 Kingston Council approved changes to the Local Law to ban smoking in parts of the city, to reduce the risk of passive smoking and keep our streets, parks and reserves, beaches and bay free of cigarette butt litter.
The changes mean you can now be fined if you light-up a tobacco product or smoke an e-cigarette on any of Council’s beaches or foreshore areas, parks or reserves, or in the major shopping precincts across Kingston.
The major activity centres of Cheltenham, Mentone, Mordialloc, Chelsea and Moorabbin are designated ‘smoke-free zones’ while smaller shopping precincts are exempt from the ban.
Under Victoria's Tobacco Act 1984, Victorian Public Premises, all of Kingston’s schools, Family & Children’s Centres and children's service premises, as well as all outdoor dining areas, including courtyard and footpath dining areas, are also smoke-free zones.
The ban includes:
- tobacco products, including cigarettes, cigars and pipes
- e-cigarettes and vapes

Signage will indicate where smoking is banned and includes:
- beaches and foreshore areas
- parks and reserves
- major shopping precincts
- schools, Family & Children's Centres and children's service premises
- outdoor dining areas, including courtyard and footpath dining areas
- Victorian Public Premises (courts, hospitals, public health services, community health centres, public service bodies)
The maximum an individual can be fined is $500 (5 penalty units) but Council is taking a proactive, educational approach to the implementation of the new law. Warnings will be issued in the first instance.
Reporting someone smoking or littering
If you wish to report someone smoking in a smoke-free zone, you can call Council on 1300 653 356.
If you see someone littering cigarette butts from their vehicle, you can report them to the EPA via the EPA Report Litter form, App or hotline on 1300 372 842.
You can report someone to EPA for littering:
- from inside a vehicle
- just before they get into a vehicle
- just after they get out of a vehicle.
