Amendment C151

&

Planning Permit Application KP16/134:

Peninsula Kingswood Country Golf Course - 179-217 Centre Dandenong Road, Dingley Village

 

The Amendment seeks to:

Rezone the land to facilitate the development of the land for residential purposes and apply a Development Plan Overlay to guide the future use and development of the land.

The planning permit application has also been lodged for consideration concurrently with Amendment C151 for the subdivision of the land, development of lots less than 300 sqm, creation of access to Road Zone Category 1, buildings and works (earth works) and removal of native vegetation.

Council at a Special Meeting held on  October 17, 2018 resolved to Abandon Amendment C151.

Amendment C166 - Signage at Moorabbin Reserve Amendment C166 - Signage at Moorabbin Reserve
Amendment C154 proposes to change the advertising sign category for the site at 32-64 Linton Street, Moorabbin (Moorabbin Reserve) from Category 4 to Category 3 Approval of this amendment is required to allow signage on the site associated with the St Kilda Football Club. A planning permit application for the signage has been lodged for consideration concurrently with Amendment C166 (KP18/121).

Amendment C149 Anomolies  

The amendment proposes to implement various corrections to the mapping of zones and overlays, in order to resolve anomalies in the Kingston Planning Scheme. The anomalies include mapping errors, redundant overlay provisions, land affected by multiple zones and land where the zone is inconsistent with its use or ownership.

Amendment C163

Tarella Road Chelsea

 

The amendment applies a permanent Environmental Significance Overlay to 19 Tarella Road, Chelsea.

Amendment C159 Gas and Fuel Site  (Highett Gasworks)

The amendment is proposed by the State Government Department of Treasury and finance and relates to their land at the Gas and Fuel site at 1136-1138 Nepean Highway, Highett. It is proposed to:

  • insert a new Schedule 2 to the Residential Growth Zone regarding increased height controls
  • apply Development Plan Overlay Schedule 7
  • delete the requirements of the Design and Development Overlay Schedule 12 which currently apply to the site
  • retain the current Environmental Audit Overlay
  • retain the current Heritage Overlay Schedule 11 which applies to the chimney

Amendment C153 - Public Open Space Contributions Amendment C153 proposes to introduce public open space contribution rates to all non-exempt subdivisions (3 lots or more).

Amendment C152 - Stormwater Management and Water Sensitive Urban Design  

Amendment C152 proposes to introduce a local policy to provide objectives and application requirements for residential and non-residential developments that require a planning permit to incorporate stormwater treatment measures (WSUD).

Approved by the Minister for Planning on 31 May 2018.

Amendment C132 - Implementation of part of the recommendations of the Kingston Planning Scheme Review 2012  Amendment C132 proposes to replace the existing Municipal Strategic Statement (MSS - Clause 21 the Kingston Planning Scheme) with a new format MSS and amends Clause 22 of the Local Planning Policy Framework in line with part of the recommendations of the Kingston Planning Scheme Review 2012 as well as other minor inconsequential changes.

Amendment C154 - Signage at Holmesglen Hospital and TAFE, Moorabbin

Amendment C154 proposes to change the advertising sign category for the site at 488-492 South Road, Moorabbin (the Holmesglen Hospital and TAFE site) from Category 4 to Category 2. The approval of this amendment is required to allow signage on the site associated with the Holmesglen Hospital and TAFE. A planning permit application for the signage has been lodged for consideration concurrently with Amendment C154 (KP16/687).

Amendment C147 - Rossdale Golf Course - Sixth Avenue, Aspendale

The Amendment proposes to rezone the land from a Special Use Zone (Schedule 1) to a General Residential Zone (Schedule 3) to allow for residential use. The Amendment also proposes to apply an Environmental Audit Overlay (EAO) to the subject land.

Concurrent to the Amendment is a planning permit application (KP15/480) for the subdivision of the land into 2 lots and the removal of native vegetation.

Amendment C147 was approved by the Minister for Planning on 24 January 2017.

Amendment C148 - Mentone Hotel

The draft amendment seeks to amend the schedules to clauses 52.03 and 81.01 of the Kingston Planning Scheme to insert an Incorporated Document titled ‘Mentone Hotel Redevelopment – 95-97 Beach Road, Mentone, May 2016’.

Specifically, the amendment seeks to introduce a site specific provision in the schedule to Clause 52.03 of the Kingston Planning Scheme to permit the land to be developed for:
a food/beverage area within part of the ground floor of the heritage-protected building

  • 11 apartments within the existing heritage-protected building
  • construction of a four-storey building in the current carpark area behind the hotel to include 45 apartments and 12 two/three storey townhouses
  • basement car parking (and alteration to existing access points). 

The exhibition period is proceeding after Victorian Planning Minister Richard Wynne gave authorisation for Planning Scheme Amendment C148 to be prepared.  The Minister has stated that “authorisation to prepare the amendment is not an indication of whether or not the amendment will ultimately be supported”.

Please note: The state heritage-protected building façade and internal staircase must be retained.As the site is listed on the Victoria Heritage Register, a permit is required for certain components of the development.  This permit was granted on the 21 January, 2016.  For further details on the Heritage Victoria Heritage Permit see bit.ly/1PJ5c8f

 

At the Council meeting of 27 March 2017, Council resolved the following:

That Council:

1. Abandons Planning Scheme Amendment C148.

2. In accordance with Section 28 of the Planning and Environment Act tells the Minister in writing of its decision to abandon Planning Scheme Amendment C148.

3. Informs the proponent of the resolution to abandon Planning Scheme Amendment C148.

4. Encourages the proponent to consider an alternative proposal that:

  • is compliant with the Design and Development Overlay two-storey limit,
  • protects and undertakes to restore the heritage-listed Mentone Hotel building;
  • maintains the traditional use of the building as a hotel, or
  • provides adequate space for a café/restaurant/bar to provide for continued community use in accordance with the tradition of the Edgy.

Amendment C161 - Hawthorn Football Club, Tootal Road, Dingley

The Amendment seeks to insert a new Incorporated Document titled ‘Hawthorn Football Club – Function Centre and Signage Controls’ into the Schedule to Clauses 52.03 and Clause 81.01 of the Kingston Planning Scheme.

Specifically, this Incorporated Document allows for:

  • A planning permit for a function centre with greater than 150 patrons to be applied for;
  • Outdoor advertising signage associated with the Hawthorn Football Club Training and Administrative Facility to an extent beyond that currently permitted under Clause 35.04-7 of the Green Wedge Zone (Schedule 2).  The incorporated document requires an advertising sign master plan to be submitted to Council prior to the display of signage on the site.

Amendment C161 was approved by the Minister for Planning on 31 August 2016.

Amendment C144 - 41-47 Melrose Street, Parkdale

The amendment proposed to rezone land at 41-47 Melrose Street, Parkdale from Commercial 2 Zone to General Residential Zone - Schedule 3, apply an Environmental Audit Overlay to the land and make consequential changes to Clauses 21.04, 21.05 and 21.06. Amendment C144 was refused by the Minister for Planning on 3 November 2016.

Amendment C143 - Green Wedge

Ministerial Approved Documentation

The amendment proposes to rezone land outside the Urban Growth Boundary north of Kingston and Heatherton Roads zoned Special Use Zone Schedule 2 (Earth and Energy Resources Industry) to a Green Wedge A Zone and introduce a Schedule with a 40 hectare minimum subdivision area.  The amendment also amends the Local Planning Policy Framework to ensure consistency with the Green Wedge A Zone and removing out-dated terminology and references.  An Environmental Audit Overlay and Environmental Significance Overlay is sought to ensure that land will be suitable for appropriate alternative uses and development in the future.

Approved by the Minister for Planning on 15 October 2015.

Draft Amendment C140 - New Residential Zones

The Draft Amendment proposes to replace the current residential zones with three new residential zones in accordance with the Minister for Planning's directions.

The Standing Advisory Committee report has been released by the Minister for Planning.  The Minister has implemented a policy neutral conversion of the former residential zones to the new General Residential Zone (Schedule 2 and 3) and Residential Growth Zone via Amendment C150.

Amendment C128  

The Amendment introduces a Design and Development Overlay to guide the built form and height of new development in the Mentone Junction precinct.  

The Amendment was approved by the Minister for Planning and was gazetted on 10 March 2016.

Amendment C125 & Planning Application KP12/1  

The amendment proposes to rezone 44 First Avenue, Chelsea Heights from Urban Floodway Zone and Public Park and Recreation Zone to Residential 3 Zone and Public Use Zone 1 (Service and Utility), amend Clause 21.05 of the Kingston Planning Scheme to include the site on the Residential Land Use Framework Plan within “Areas for promotion of Incremental Housing Change” and enable a planning permit to be issued for the subdivision of land into 25 lots.

C125 (Part 1) has been approved and was gazetted on 7 August 2014.  Planning Application KP12/1 has been issued. 

 

 

Amendment C124 - Mentone Activity Centre Zone

 

The amendment applies to land in the Mentone Activity Centre. The amendment proposes to: Rezone land in the Mentone Activity Area to the Activity Centre Zone, Introduce the Activity Centre Zone at Clause 37.08 and Schedule 2 to the Kingston Planning Scheme, Delete Design and Development Overlay Schedule 18 at Clause 43.02, Modify the Municipal Strategic Statement at Clause 21.05 and 21.06, Amend Maps 4 and 5 to introduce the Activity Centre Zone 2, Amend Maps 4DDO and 5DDO to delete DDO18. The Minister for Planning has refused Amendment C124 and exercised his power under Section 20(4) of the Planning and Environment Act to approve a new permanent Schedule 18 to the Design and Development Overlay (DDO18) in line with the adopted Mentone Structure Plan (2011).  The new DDO18 has been implemented via Amendment C160 which was gazetted on 16 October 2014.
Amendment C121 - Moorabbin Activity Centre Zone  

The amendment applies to land in the Moorabbin Activity Centre. The amendment proposes to: Rezone land in the Moorabbin Activity Area to the Activity Centre Zone, Introduce the Activity Centre Zone at Clause 37.08 and Schedule 3 to the Kingston Planning Scheme, Delete Design and Development Overlay Schedule 19 at Clause 43.02, Modify the Municipal Strategic Statement at Clause 21.05 and 21.06, Amend Map 1 to introduce the Activity Centre Zone 3, Amend Map 1DDO to delete DDO19.   

Approved by the Minister for Planning on 12 March 2015.

Amendment C111   The amendment proposes to rezone the Southern Road North Precinct from an Industrial 1 Zone to a Residential 3 Zone; Apply an Environmental Audit Overlay to the land affected by the amendment; Include the land within a Schedule to the Design and Development Overlay (DDO); Amend Clause 21.07 Industrial Framework Plan of the Local Planning Policy Framework by deleting the Southern Road Precinct as an existing industrial area and including the area in the medium to long term redevelopment for housing and/or mixed uses; and Amend Clause 21.05 Residential Land Use Framework Plan of the Local Policy Framework by including the area for promotion of Incremental Housing Change.   

Refused by the Minister for Planning on 5 August 2015.  The Minister's decision to refuse the Amendment was predominately based on the grounds that the Amendment was inconsistent with planning for airports in the State Planning Policy Framework which includes a clear strategic direction to prevent inappropriate development, such as residential uses, around Victoria's airports.
